The Effective Date of the Examagram Privacy Policy is from the 2nd-April-2014

Your privacy is important to Examagram. Please read this Privacy Policy carefully as it forms part of the Terms of Use which govern the use of the Examagram Services and Websites.

This Privacy Notice explains-:

1 – The type of information about you which is processed by Examagram when you use the Examagram Services and/or the Examagram Websites;

2 – How Examagram processes the personal information about you when you use the Examagram Services and the Examagram.com Websites;

5 – The class of third parties to which Examagram may disclose your personal information to;

6 – Whether it is obligatory or voluntarily for you to supply the personal information and the consequences of failing to provide your personal information when it is obligatory; and

7 – How Examagram safeguards the confidentiality and security of your personal information.

Any changes will be notified to you via the e-mail address provided by you on registration or via a suitable announcement on the Examagram Websites. All e-mail addresses associated with user (examiners) accounts will be e-mailed including user (candidate) profiles. The changes will apply to the use of the Examagram Services after we have given you notice. If you do not wish to accept the new Terms you should not continue to use the Examagram’s Services or the website. If you continue to use the Examagram Services after the date on which the changes comes into effect, your use of the Examagram Services indicates your agreement to be bound by the new Terms.

Definitions used for this Privacy Notice:-

“Examagram“, “Examagram Services“, “Examagram.com Websites“, “You“, “Advertisers” “Candidates”, “Users” and “Examiners” shall have the same meaning as defined in the Terms of Use.

“personal information” or “information” is data that can be used to identify an individual.

“processing” includes but is not limited to collecting, holding, storing, recording, organizing, adapting, using, disclosing, correcting, destructing.

“Third party” includes anyone that is not “you” or “Examagram”

1 – COLLECTION OF INFORMATION

1.1 – When you register for the Examagram.com Services

1.1.1 - Each time when you register with Examagram for any of the Examagram.com Services, you will be asked to provide certain personal information about yourself in order to create an Examagram account.

1.1.2 – The information collected during the registration process includes but is not limited to your email address, name, country of residence, company and position.

1.1.3 – Whenever the personal information requested by Examagram is marked as “Required Field”, you must provide and agree to the processing of this information by Examagram.com. If you do not agree to provide this personal information and/or not agree to us processing it in the manner set out in this Privacy Notice, then Examagram.com may not be unable to provide the relevant services to you and your application for such services could be rejected.

1.1.4 – From your use of the Examagram.com Services and/or the Examagram.com Websites we will gather information from you and will assume that you have the necessary permissions to provide Examagram with the information. This includes candidate information submitted by examiners.

1.1.5 – If you choose to use Examagram Services to tell a friend about its services or use Examagram to send on test result information, Examagram.com will ask for your friend’s name and e-mail address. An e-mail inviting your friend to use the Examagram Services or to visit the Eamagram.com Websites will be sent to him/her automatically. Other e-mails to third parties and candidates are automatically sent at relevant times during the test procedure.

1.1.6 – If you wish to stop Examagram.com from processing this type of personal information about you, Examagram.com may no longer be able to provide the relevant services to you.

1.1.7 – In addition, Examagram.com may ask your permission to post your testimonial or success story or for referrals. If you agree to post your material on Examagram.com Websites or any associated publication, you should be aware that any personal information you submit can be read, collected, or used by other users of the Examagram.com Websites and could be used to send you unsolicited messages

1.2 – When you visit the Examagram.com Websites

1.2.1 – When you visit any Examagram.com Websites our web servers automatically collect information about your visit to these websites, including your Internet Protocol (IP) address, the time, date and duration of your visit. Your IP address is a unique identifier for your computer or other access device.

1.2.2 – Examagram.com may track your visits to any Examagram.com Websites by placing a “cookie” on your computer or other access device when you enter. Cookies are small text files that are placed on your computer or other access device by websites that you visit. They are widely used in order to make websites work, or work more effectively, as well as to provide information to the owners of the websites.

1.2.5 – Examagram.com also uses clear gifs in its HTML-based emails in order to find out which emails have been opened by the recipients. This allows Examagram.com to gauge the effectiveness of certain communications and the effectiveness of its marketing campaigns.

1.2.6 – Our partners and service providers use cookies to collect information about the usage of Examagram.com Websites. The use of cookies by our partners and service providers is not covered by our privacy policy. We do not have access or control over these cookies.

 

2. PURPOSES OF COLLECTING AND USE OF PERSONAL INFORMATION

2.1 – The purposes for which Examagram.com processes your personal information are as follows:-

2.1.8 – To monitor and improve the performance of the Examagram.com Websites and the Examagram.com Services;

2.1.9 – To maintain and develop the Examagram.com Websites and Examagram.com Services;

2.1.10 – To gain an understanding of your information and communication needs in order for Examagram.com to enhance and customize the Examagram.com Services;

2.1.11 – To conduct research and development and statistical analysis in connection with the Examagram.com Services to identify trends and develop new services that reflect your interests. We reserve the right to send this on to a third parties can offer products and services to you that are relevant to these trends and development services; (to be clear this includes unassociated businesses to Examagram)

2.1.12 – To assist Examagram.com in understanding your browsing preferences on the Examagram.com Websites so that Examagram.com can tailor content accordingly;

2.1.13 – To detect and prevent fraudulent activity.

2.2 – You are not able to limit the processing of your personal information for the purposes set out in Clause 2.1 above. If you do not consent to Examagram.com processing your personal information for the said purposes, you must terminate your relevant agreement with Examagram.com for the Examagram.com Services and stop using the Examagram.com Websites.

2.3 - Examagram will ask for your consent before processing your personal information other than those set out in Clause 2.1 & 2.5.

2.4 – Examagram will NOT release any information regarding user (candidate) information that has not subsequently been verified by the user (candidate) by agreeing to the terms and conditions and this Privacy Policy. To be clear, it is solely the responsibility of the user (examiner) to ensure that the candidates is fully aware of the information that is being provided up until the candidate decides to take the test (thus agreeing to the terms and conditions and the privacy policy). Any information given by the examiner and therefore any liability relating to the information is solely with the user (examiner). Once the user (candidate) has started the test, they have fully agreed with the terms and conditions laid out in this document (and Terms and conditions) and they are in full understanding that they are then responsible to ensure that the examiner has submitted correct and accurate information on their behalf in relation to their profile. Examagram will assume that the candidate has given full permission for the information to be shared. It is the candidate’s responsibility to inform Examagram of false or unauthorized information being given past the point of starting the test. You agree to defend, indemnify, and hold harmless Examagram, and its affiliates, and their respective officers, directors, employees, and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from any non-consented or falsified information that has been submitted by you the user. At any time the user (candidate or examiner) can request the information that has been provided and the e-mail address will be the source and proof for the identity.

2.5 -In addition, Examagram.com may use your personal information for the following purposes:-

2.5.1 – To promote and market to you:

2.5.1.1 – Other Examagram.com Services; or

2.5.1.2 – Services of third parties which Examagram.com thinks may be of interest of you;

2.5.2 – To send you seasonal greeting messages and/or message informing you of a critical performance error in the Examagram.com Websites and/or the Examagram.com Services.

2.5.3 – To send you tips, advice and survey information to maximize your career development your skills including but not limited to using the EXamagram.com Services and/or the Examagram.com Websites.

4.CHOICE of Account

4.1You can choose to delete your Examagram account at any time in which event Examagram.com will remove all access to your account and in the database.

5.RETENTION OF INFORMATION

5.1 – Examagram.com will retain your information for the period necessary to fulfill the purposes set out in Clause 2 above and any legal or business purposes.

6.SECURITY OF INFORMATION

6.1 – Examagram.com is committed to keeping information secure. Examagram.com has appropriate technical, administrative and physical procedures in place to protect information from loss, theft and misuse, as well as against unauthorized access, disclosure, alteration and destruction.

7. TO WHOM PERSONAL INFORMATION IS DISCLOSED

7.1 All Information submitted and the user action (including usage behaviors) can be disclosed to the classes of third parties as follows in order for Examamgram.com to effectively manage its business including to render the Examagram.com Services to you to achieve the purposes described in Clause 2 & 5:-

d. – Mapping services;

e. – Maintenance and repair services

f. – Recruitment agencies

g. – Potential Employers

h. – Market research and website usage analysis services.

h. – Strategic partners that work with Examagram.com to provide the EXamagram.com Services or that help market and promote Examagram.com Services.

I .The school/college/university/institutes

j. – Professional qualifying bodies;

k . – Regulatory bodies, governmental bodies or other authorities if required or authorized to do so to discharge any regulatory function, under any law or in relation to any order or judgment of a court;

l. – Regulatory bodies, governmental bodies or other authorities for the purpose of detection or prevention of crime, illegal/unlawful activities or fraud or for the apprehension or prosecution of offenders, or for an investigation relating to any of these;

m. – Any party involved in or related to a legal proceeding (or prospective legal proceeding), for purposes of the legal proceedings;

8.2 – In the circumstances you may need to provide to Examagram.com personal information about someone other than yourself (for example, a candidate or a third party). If so, we rely on you to inform these individual that you are providing their personal information to Examagram.com, to make sure they consent to you giving us their information and to advise them about where they can find a copy of this Privacy Notice (on our website at Privacy Policy)

9.TRANSFER OF YOUR PERSONAL INFORMATION OUTSIDE OF YOUR LOCAL JURISDICTION

9.1 – It may be necessary for Examagram.com to transfer your personal information outside of your local jurisdiction if any of Examagram’s service providers or strategic partners (“overseas entities”) is involved in providing part of the Examagram.com Services.

10.LINKED SITES

10.1 – Examagram.com Websites that may contain links to third party sites. Examagram.com is not responsible for such third party sites. Any personal information made available by you on such sites will not have the benefit of this Privacy Notice and will be subject to the relevant third party’s privacy policy (if any).

10.2 – You can login to our site using sign-in services or recommend our site on websites such as Facebook, Twitter and Linked in. This service will authenticate your identity and provide you the option to share certain personal information with us such as your name and email address to pre-populate our sign-up form. Services like Facebook Connect, twitter and linked in give you the option to post information about your activities on this website to your profile page to share with others within your network.

10.3 – Our website includes Social Media Features, such as the Facebook, linked in & Twitter buttons and widgets, or interactive mini-programs that run on our site. These features may collect you IP address, which page that you are visiting on our site, and may set a cookies to enable the Feature to function properly. Social Media Features and widgets are either hosted by third party or hosted directly on our site. Your interactions with these Features are governed by the privacy policy of the company providing it.

11.1In using the EXamagram.com Services and/or the Examagram.com Websites, you consent to the collections and use of the personal information by Examagram.com in the ways described hereinabove (which may change from time to time) unless and until you inform Examagram.com to the contrary here.
